E-Discovery

Research indicates that 99% of all business documents are now created and stored in electronic format. Our e-Discovery practice group focuses on the practical and legal implications associated with managing this electronically stored information (“ESI”). ESI is discoverable in litigation. Recent court cases, as well as amendments to the Federal Rules of Civil Procedure, provide guidance to businesses in managing ESI.

The attorneys of our e-Discovery Practice Group have experience in handling ESI in complex litigation. In addition, our attorneys are uniquely positioned to evaluate and understand complex technical issues.

From overseeing the retrieval of “lost” or deleted data, to assisting clients with document retention policies, our attorneys regularly provide proactive, practical advice to clients in all aspects of ESI management.

Employment Law and Labor Relations

Our goal is to offer preventative counsel and guidance to employers, enabling achievement of work force objectives and avoidance of pitfalls which frequently result in costly and disruptive grievances, charges before administrative agencies, or litigation.

We are experienced advocates for employers in a variety of Equal Employment Opportunity matters. We have represented employers before local and state civil rights enforcement agencies and in federal and state courts in discrimination cases including: sexual harassment; disability claims; and sex, race, age, religious, and other claims of discrimination. In addition, we are well-versed in claims of wrongful discharge, “whistle-blower” and retaliatory discharge litigation.

We represent clients in collective bargaining processes including unit organization, administering the collective bargaining agreement, grievance evaluation, and arbitration, and are experienced in representing clients before the National Labor Relations Board, the Department of Labor, and other agencies.

We are also experienced in health care bond financing, pension and profit-sharing plans, organizational policy development, not-for-profit taxation, employment and personnel matters, and litigation and arbitration in the health care industry.

We manage and oversee problems which arise in the immigration process, whether in labor certifications, reduction in recruitment issues (RIRs), immigration petitions, visas, or other processes filed with the U.S. Citizenship and Immigration Services (formerly the Immigration and Naturalization Service) or the Department of Labor.

Our attorneys are also experienced in family and marriage petitions, religious worker visas, adjustment of status and employment authorizations, and the appeals process for visa denials.
